European works councils and SE representative bodies

Acting as an employee representative on the supervisory or administrative board of a company – whether a European Company (SE), a company to which the EU Directive on cross-border mergers applies, or the national-level board of a multinational company – requires specific skills and knowledge.  Such representatives will often be confronted with issues emanating from European company law.  Moreover, these representatives represent not only the interests of employees in their home country; but also have to take into consideration the impact of strategic decisions on all staff, wherever they are located.  Therefore, an open and continuous interaction with the European Representative Body and with local worker representatives is crucial.  In such cases, the obligation to respect confidentiality can be rather problematic.
